FRYEBURG BOARD OF APPEALS
Meeting - May 11, 2010
Call to order at 6:30 . Review of April 6th, 2010 minutes. Motion by Milia to accept minutes. Unanimously approved.
Members present: Angelo Milia, Greg Huemmler, Virginia Howe, James St. Pierre
Review of petition presented by Paul Harriman. Applicant present with wife, Marcey Harriman. Petition pertains to 152 Union Hill Road .
Milian notes that petition contains sketch plan created by Bliss and Assoc.
Warranty deed is included in petition as well as application receipt.
Application deemed complete by Milia.
Milia confirms steps taken to procure a permit by the applicants.
Next meeting to discuss application scheduled for June 1st.
Milia asks about details of petition concerning modular home.
Milia also advises applicants to notify all neighbors within 500 feet.
Huemmler notes that sketches in application do not concur with town records. Huemmler gets reduced copy of town property lines to review. Huemmler explains the discrepancy between sketch in application town map regarding lot border. Issue is resolved in terms of map and discrepancy.
Milia asks if they've hired surveyors. The applicants claim that the bank hired the surveyors and that the applicants paid for it.
Motion to accept application approved unanimously.
Milia tells applicants they can leave. Applicants leave.
Milia points out that there are some discrepancies between the Bliss maps and the town's map.
Howe asks question about looking at property and procedure involved. Code Enforcement Officer explains the policies regarding site visits. Howe points out text regarding site visit. Milia reads text and interprets that a single individual should not do a site visit, only a majority of board should conduct a visit.
Code Enforcement Officer offers to take pictures and send to board members.
Huemmler points out that information gathering presents no legal problems when board members view property from the road.
Huemmler objects to scheduling visits due to added layer of bureaucracy.
Discussion leads Milia to get legal opinion from town lawyer concerning site visits. Milia will talk with Malia, the town lawyer.
Motion to adjourn unanimously accepted.
