FRYEBURG BOARD OF APPEALS
Draft Minutes - April 6, 2010

 

Call to order at 6:30

Members present: Greg Huemmler,  Kimberly Clarke , Angelo Milia, Virginia Howe, James St. Pierre

Minutes from Board of Appeals meeting on 3/16/10 reviewed. Accepted unanimously. 

Second order of business refers to variance requested by property owner. A representative for property present.

Milia  refers to variance code in Section 11 of ordinance. Asks representative of property why owner is not here and Milia raises concerns about the septic system. 

Clarke asks about size of property in relation to variance request.

Clarke asks if property is categorized as a multi-family structure. Representative states that it is a currently a two-family dwelling.

Huemmler asks if proposed units are for rental or a single family. Representative says it will be a rental property.

It will be handicap accessible. 

Milia asks if owner is handicapped. Representative says no.

Huemmler asks for clarification on what exactly will be renovated. 

Clarke states a concern about owner not being available and provisions for variances. 

Huemmler clarifies that hardship doesn't necessarily involve not being able to profit from property.

Representative says the property is massive and wasted space. Some renovations already under way. 

Clarke asks if owner wishes to buy an adjoining lot to bring the lot size into conformity. Representative states that this is not the plan.

Huemmler asks again about the septic system and the capability of the soil design.

Milia says this is the meeting to bring forms such as the soil design.

Representative says not everyone notified by certified mail.

Clarke motions to reject variance request. Unanimously approved. 

Huemmler comments that there is still a possible avenue of redress to work with property.

Clarke suggests the owner refer to the variance ordinance in section 18-2. 

Motion to adjourn at 6:48 . Unanimously approved.
