Minutes Fryeburg Planning Board
February 26, 2007 7:00 pm
Town Office

Board members present, P. Hill, T. Raymond, G. Bergoffen, M. Holtgrefe, and associate David Andrews sitting in for Carol Gregory. Kathleen Heggie and Carol Gregory were excused.

The meeting was called to order at 7:00 pm and a quorum was declared.

Public Hearing and application review. Proposed Restaurant at 2 Jockey Cap Lane, Ron Ela.

A letter from Jon Bliss was referenced indicating that the septic system is acceptable for the restaurant. Roger Brown, abutter to the restaurant, asked about hours of use and if the restaurant didn’t work out would it eventually turn into a bar.

Ronald Ela stressed the application is only for a restaurant where lunch and dinner will be served.

Mr. Brown was also concerned about the potential for trash blowing into his yard and people walking thru his yard during operating hours. He reques ted that a fence be put between his property and the restaurant. Chairman Bergoffen poin ted out that there is no ordinance requirement for fencing, and sugges ted this be a matter for discussion between the parties.

Mike Holtgrefe made a motion to approve the application exclusively for use exclusively as a restaurant for a maximum seating of 64 persons with the conditions that Mr. Ela acquire necessary access permits from the Maine DOT, and that no other use on the property is authorized by this approval. Ted Raymond seconded it. The action will include a of Section 16 requirements for landscaping with shrubs along property lines. The board was unanimous in favor to approve the application. It was no ted that the nonconforming setback along Route 302 would be continued.

The Board unanimously approved the application with the conditions and waivers no ted above.

Fryeburg Academy – Informational review of planned arts building.

Frank Crabtree, P.E. Harriman Associates, presen ted preliminary plans of the

Fryeburg Academy for a performing arts building. The property is loca ted in Village Residential and Outlying Village Residential zones, and will qualify for Planning Board consideration under section 5.6 of the Land Use Ordinance.

The Academy will seek Fire Department approval of a building height of 45’. The Planning Board will seek to schedule a joint meeting with the Fryeburg Board of Planning Appeals for consideration of a variance for the building height and a non conforming set back in the front of the building.

Review of Hugh Hastings Proposed Property Use

Mr. Hastings sought Board views about a potential market at the old rest area

on Route 113 near the state line. A potential lessor would like to sell farm and other goods from a stand or trailer. The Board’s consensus was that the use would have to meet the specific requirements for a farm stand, or it would not likely qualify for permit under the sale of goods provisions of the Land Use Ordinance.

Approval of the minutes.

Gene Bergoffen sought approval of the amended minutes of the January 29 meeting. The minutes were unanimously approved.

Upon motion duly approved, the meeting was adjourned at 8:15 pm.
