Minutes Fryeburg Planning Board

Board members present, P. Hill, T. Raymond, G. Bergoffen – chair, Michael Holtgrefe, Kathleen Heggie and associate David Andrews sitting in for Carol Gregory, who was excused

The meeting was called to order at 7:00 pm and a quorum was declared.

Application Review – Proposed Restaurant, 2 Jockey Cap Lane, Ron Ela

After discussion, the Board decided to treat this discussion as an application review, with the understanding that items required by section 17 R of the Land Use Ordinance need to be better documented prior to the planned public hearing on the matter. The application needs to state the maximum seating capacity of the restaurant and what restroom facilities will be provided.

Mr. Ela stated that 25 – 30 parking spaces are being considered and he is going to put a buffer between the property and the mini mall next door. This will require taking a few trees down. He is also making provisions for some landscaping to be done.

Ted Raymond made a motion to find the application complete, and that Boni Rickett, CEO, will asked to work with Mr. Ela to assure that required items are provided and documented prior to a hearing on the application, scheduled for February 26. David Andrews seconded the motion and it was unanimously accepted.

Water Resource Protection Ordinance

The Board reviewed the latest draft of the Ordinance, (draft dated January 29, 2007) prepared to respond to the input received form the informational sessions and the January 24 hearing. Also discussed was an issues paper (attached).

All items on the issues paper were dealt with, and, in the absence of a positive motion, the Board decided not to include provisions limiting export of ground water from Fryeburg.

Michael Holtgrefe made a motion to adopt the draft as amended, and to recommend to the Board of Selectmen that the ordinance be presented to the town meeting as a warrant article. This was seconded by David Andrews and all were in favor.

Comprehensive Planning. Discussion of next steps in Comprehensive Planning Process.

Based on the complexity of State Comprehensive Planning processes, and the state of flux with respect to State Planning Office requirements, the Board agreed to sponsor a public forum on next steps for the Planning Process, and to invite JT Lockman of the Southern Maine Regional Planning Commission to participate in the forum. Chairman Bergoffen asked Ted Raymond to continue in a lead role in the process, and the forum will be scheduled in the near future.

Administrative Matters

David Andrews made a motion to approve the December 11 Planning Board minutes and

it was unanimously accepted.

The next Planning Board meetings are set for Monday nights, February 26 th and March 26 th.

The meeting was adjourned at 9:02 pm.
