Board of Selectmen Meeting Minutes
December 6, 2007

The meeting was called to order at 6pm. A quorum was declared.

Public Hearing – Renewal of Water Extraction Moratorium.

The moratorium is beyond the actual six month anniversary date (having expired on October 4, 2007). This would be the 4 th extension. Peter Mailia, Town Attorney has offered the legal opinion that since the statute is silent regarding the scheduling of moratorium renewal hearings, that the moratorium could be renewed past the expiration date if it met all the other statutory criteria.

There was considerable discussion regarding the pros and cons or extending the moratorium. Peter Fletcher suggested putting the issue of bulk water extraction before the voters as a yes or no question. This view was also supported by John Snyder.

Mr. Hummler stated that water is just a commodity now. Mr. Hall stated that it is important to protect our water as it is essential for life.

The public hearing was closed at 6:40 pm.

After further discussion,. Cliff Hall made a motion to extend the water moratorium 180 days. Ed Wilkey seconded the motion for discussion. David Knapp made a motion to amend the original motion to extend the 2005 moratorium 180 days from its last expiration (10/5/07). The motion carried 2-1 (Mr. Wilkey opposing).

Public Forum

Mr. Hummler thanks the persons responsible for returning the metal Fish Street sign.

Mr. Fletcher voiced a concern for holding a town vote on the subject of extraction of water for commercial purposes. Mr. Knapp commented that that would be one course of action to take and that next week a workshop has been scheduled to discuss water issues. It was noted that in the November 2007 election the vote on the water processing and transportation moratorium was 467 votes in favor of the moratorium and 304 opposed.

Review of submitted correspondence to the board.

Robert Williams submitted a letter requesting $1,500.00 be raised in the next Fryeburg town budget in support of the Charlotte Hobbs Library in Lovell. Mr. Knapp directed the town manager to write a letter back thanking them for the request and that it would be added to the agency requests during the next budget process.

Michele Broyer submitted a letter regarding the Saco River Clean up. She would like to get a committee together and put out a booklet on Lovewell Pond listing preventative milfoil measures. She also suggested constructing a boat wash station at the landing. This will be referred to the Parks committee for their next meeting.

Board Appointments

There are not any new applicants since the last time this issue was discussed. This will be addressed at a future workshop meeting.

Managers Report

The Town Emergency plan will be completed and presented to the Board by 12/20. A DVD collection and list of recorded meetings is almost complete.

FCR recycling is working on their version of a cost benefit analysis for single stream recycling.

The ADA access project at the American Legion starts next week.

The drainage easements for the Haley Town Road project have been recorded at the registry of deeds at a cost of $14.00 each. Mr. Malia is working on the Police Mutual Aid Agreement.

New Business

Discussion with the treasurer regarding Town’s possible participation in a Section 125 Plan. Plan documents were distributed to the Board members for their review.

Mt Washington Valley Economic Council Update by Conrad Eastman.

Mr. Eastman gave an update on the activities of the Economic Council whose mission is to try to improve the employment situation in the Mount Washington Valley area. He spoke briefly about the operations of the Tech Village in Conway. There is currently room for additional start-up companies at the facility. He recalled that there were two Fryeburg businesses that he recalls being assisted by the council in the past.

Review of Bids – Surplus Property-Former Highway Department Ford Bronco.

There are two bids that were put in for the Bronco. One is for $250.00 and the other for $275.00 from B&C Auto Body. Ed Wilkey made a motion to award the sale to the higher biddder at $275.00. Cliff Hall seconded it and the motion passed unanimously.

Fryeburg Lions Club

The Lions Club has requested a donation for the Christmas Baskets. The donation is for the food that goes into the baskets. The request was forwarded to the General Assistance Adminstrator.

Review of Bids – Municipal Solid Waster Hauling.

Two bid were received. Waste Management submitted abid for $260.00 per-haul plus additional charges for container rental. North Conway Incicnerator submitted a bid for $210.00 per-haul increasing $10.00 per contract year for three years. The contract was awarded to North Conway Inicnerator Service.

CMP – Power Pole Permit

There are ten poles on Union Hill Road that need replacement. Cliff Hall made a motion to approve the application from CMP to replace the ten poles. Road. David Knapp seconded the motion and it passed unanimously.

Discussion re- Scheduling of Public Hearing related to Menotomy Road weight limitations.

A public hearing will be scheduled for 12/20/07. The Selectmen were presented with a list of 16 people that want to put weight restrictions on that road. The Public Hearing Notice will be advertised.

Old Business

Haley Town Project – end of construction season/report work change order:

The change order is for a fence and mailbox replacing a line of trees that were removed from in front of one person’s home. This was unanimously approved. Burr Phillips suggested posting the road in the spring. Loaming, seeding and the top coat of pavement will be placed in the spring. Mr. Phillips will prepare an estimate for Phase II in March 2008.

Ed Wilkey noted that the gate on River Road has been opened and the road plowed.

It was also noted that Porter Road is closed to winter maintenance.

Ed Wilkey made a motion to go into executive session. The meeting was adjourned at 9:05 pm.
