Town of Fryeburg The meeting was called to order at 6pm and a quorum was declared. Review and Approval of the Minutes of 4/19/07. Cliff Hall made a motion to adopt the minutes as printed. David Knapp seconded the motion and a vote of 2-0 was deemed unanimous. (Wilkey abstaining since he was not present at that meeting) Public Forum. Mr. Krasker reported that a check for $11,000.00 from the Maine Community Foundation should be arriving to further support the study of water withdrawal and its potential effects on Lovewell Pond. The money was requested by Mr. Krakser on behalf of the Planning Board. The study will be done over the summer of 2007. Treasurer’s Report Treasurer Ella Cressy submitted a report showing the balances in the operating accounts. The issue of sorting out all the different cemetery trust fund accounts was raised. Ms. Cressy will confer with Diane Jones of the Historical Society to attempt to ascertain what funds were donated for the maintenance of what cemeteries. Annual Appointments – Town Boards, Committees, Officers The town manager submitted a detailed list, along with the appropriate appointment papers to the Board for consideration for appointment/reappointment. The list is herby attached and incorporated into these minutes by reference. Mr. Wilkey moved to appoint and/or reappoint the individuals on the list as submitted. Mr. Knapp seconded the motion. The motion passed unanimously. Mr. Wilkey volunteered and was appointed as Board Representative to the Saco River Recreation Council. Appointment of the Southern Maine Regional Planning Commission General Assembly Members: Cliff Hall and David Knapp volunteered to represent the town at the annual meeting. Oxford County Emergency Management Agency – Fairground Exercise update. Scott Parker, Emergency Management Director for Oxford County reported that an exercise will be held at the Fryeburg Fairgrounds on Saturday May 19 th. Approximately two hundred and fifty responders including fire, EMS and hospital, police, and Life- Flight personnel will participate. Three hospitals are involved. The Molly Ockett Middle School will be opened as an approved Red Cross shelter. The exercise will take place in the rear of the fairgrounds out of the way of the flower show. Press coverage will begin this week so the public will be aware of what is going on. An after action critique will be held on or about May 30’th; the exact date, time and location to be determined. Discussion RE- Water issues Mr. Gamwell suggested an amendment to the current Water Extraction Moratorium that would add to the list of prohibited activities any activities “which involve the bulk transportation of water through the town of Fryeburg or for any operations under any such permits unless substantial activities have commenced under such permits.” There was discussion regarding the legality of amending the current moratorium and the procedure for doing so. After discussion, this issue was scheduled as a work-session discussion for May 17’th with a possible public hearing to be held on May 24’th should the Board decide to do so. A legal opinion on the matter will be solicited. The Planning Board is also suggesting proposed amendments to the Wellhead Protection Zones for consideration at this June’s Town Meeting. Mr. Hall commented that there was no rush to amend the ordinance and the issue need more study and consideration before any ordinance amendments were proposed. The Planning Board is holding a Public Hearing on the proposed amendments on May 22, 2007 at 7 PM at the Rescue Barn. Discussion re- Public Health Office Notification Protocols. Mr. Knapp commented that due to the recent meningitis case, a standard protocol was needed to coordinate efforts among the School District, Fryeburg Academy and the local Health Officer. The Town Manager was directed to confer with the parties concerned to work out a notification process. Review of Maine Department of Transportation Biennial Work Plan. There was discussion regarding the Fryeburg projects as listed in the plan. The undertaking of any of the projects would be dependant of funding, primarily from state transportation bonds to be proposed for approval by the voters at state elections to be held in June and November 2007. A list of the planned projects appearing on the list is hereby attached and incorporated into these minutes by reference. Maine Department of Transportation Overweight Vehicle Permit ( Crick Brook Bridge Project) This state-sponsored project consists of replacing culverts on Harbor Road and Shave Hill Road. The municipality is allowed to require the contractor to post a bond to cover any damage to town roads which may occur due to the transportation of construction materials or equipment. Members of the Board suggested a $250,000.00 bond be required. Mr. Wilkey moved to issue the permit only after a $250,000 .00 bond was posted by the selected contractor. Mr. Hall seconded the motion and it passed unanimously. Haley Town Road Mr. Milia asked what the status of the Haleytown road reconstruction was. Burr Philips, the consulting engineer is scheduled to report to the Board on May 24’th on the issues of easements, permits, and utility relocation. Some portions of the project are preliminarily scheduled to put out to bid in late May or early June 2007. The project will be done in phases, as funding allows, starting at the Route 302 intersection and heading southeast. Available funds will only allow for the completion of a portion of the project at this time. Old Business Other Business as appropriate. A memo of the agreement between the Academy and the town concerning the operation and maintenance of the “Legion Field” was signed. Ed Wilkey made a motion to enter executive session discussions regarding real estate, Legal and personnel matters (Pursuant to 1 M.R.S.A. §405). The meeting entered into Executive Session at 9:05 pm. The regularly scheduled meeting was resumed at 11:00 PM. Having no further business, the meeting was adjourned.
