Board of Selectmen Meeting Minutes
February 15, 2007

The meeting was called to order at 6pm.

Members present: Jim Dutton, Ed Wilkey.

Review and approval of the minutes of 2/1/07

Tabled until the minutes are prepared.

Public Hearing –Winter Road Closings: The Public Hearing regarding winter road closings was opened. The roads considered are all and the same as were previously closed with minor changes. All road parameters are now identified by E-911 address and/or Map and Lot number. A list of the roads concerned is hereby attached and incorporated into these minutes by reference. There was no public comment on any of the roads. Mr. Wilkey moved to approve the closing list as printed. Mr. Dutton seconded the motion and it passed unanimously.

Public Hearing- Discontinuance of Former State Aid Highway #5: The Public Hearing regarding the discontinuance was opened. Mr. John Weston was present to explain the circumstances surrounding the road relocation in 1947. This former road led to the covered bridge over the Saco River that was replaced in 1947. (The 1947 bridge has since been replaced by one constructed in 2006). Mr. Weston reported that at the time a verbal agreement to relocate the road to its present location was reached between the Westons and the Maine Department of Transportation. Since then, the former road was incorporated into the driveway and lawn area of the Weston’s property, but was never formally discontinued. The local municipality is responsible for the discontinuance procedure since the former road was classified as a “ State Aid Highway” and not a State Route.

There was no other public comment. After discussion, Mr. Wilkey moved to approve the discontinuance, contingent upon approval by the voters at the March 2007 Town Meeting. Mr. Dutton seconded the motion and it passed unanimously. The Board members signed the road discontinuance documents as prepared by the town manager. The final voter-approval of discontinuance will be placed as an article on the 2007 Town Meeting Warrant.

Public Hearing –Games of Chance-Raiders Booster Club- Brad Littlefield was present to ask for approval for the annual Casino Night games of chance to be held at the Fryeburg Fairgrounds. He reported that the location and the types of games were as approved last year. He asked that the Selectmen issue a “blanket letter of approval” so that a Public Hearing would not have to be held annually for the same event. Mr. Wilkey commented that he was in favor of doing so as long as the event was held at the same place. He stated that any future change in venue would require a public hearing so that neighbors concerns, if any, could be heard. After discussion, Mr. Wilkey moved to sign the individual application and the blanket letter of approval as modified to disallow any change of venue. Mr. Dutton seconded the motion and it passed unanimously.

Public Forum: None.

Old Business:

Discussion regarding the Fryeburg Rescue Agreement and Lease: Steve Goldsmith and Bob Ramsey of Fryeburg Rescue were present to answer any questions. The members of the Board reviewed the latest draft. There were no questions. Mr. Goldsmith stated that the agreement and lease would be presented to the Rescue Association membership at their meeting on February 21’st. Mr. Wilkey moved to sign the Agreement and Lease. Mr. Dutton seconded the motion and it passed unanimously. The proposed lease will have to be ratified by the voters at the March 2007 Town Meeting and a warrant article will be drafted for consideration.

Further discussion regarding Garland Lane Road Acceptance:

Road Commissioner Gary Whitten further reported that in his opinion the road would need to be resurfaced within the next 3-5 years. Mr. Milia reported that after discussion with his neighbors, they did not want to pursue the citizen petition to place the matter on the Town Meeting warrant. Mr. Dutton commented that he would be willing to place the item on the warrant but would not recommend its passage. The Board members decided not to place the question on the warrant for this year’s Town Meeting. They stated they would be willing to do so if the road was repaved.

Mr. Milia thanked the board for its consideration.

Appointments:

Health Officer: Mr. Wilkey moved to appoint Anne Trumbull as Health Officer. Mr. Dutton seconded the motion and it passed unanimously.

Registrar of Voters: Mr. Dutton moved to appoint Deborah Tait as Registrar of Voters. Mr. Wilkey seconded the motion and it passed unanimously.

Quitclaim Deed-Release of Tax Lien:

Board members signed a Quitclaim Deed to release a tax lien on 2004 taxes for property identified as Map 24, Lot 001.

Having no further business, the meeting was adjourned.

BOG POND ROAD: From its intersection with Maine Route 5 in an easterly direction to a point adjacent to the property identified as 270 Bog Pond Road, and further identified as part of the property depicted on Map 14, Lot 17C of the tax maps of the Town of Fryeburg.

CLAY POND ROAD: From its intersection with Porter Road to its intersection with Lyman Drive.

DRIFT ROAD: From a point adjacent to the property identified as 30 Drift Road, and further identified as part of the property depicted on Map 41, Lot 10 of the tax maps of the Town of Fryeburg, in a westerly direction to the road’s terminus.

HEMLOCK BRIDGE ROAD: From a gate located at a point adjacent to the property identified as 210 Hemlock Bridge Road, and further identified as part of the property depicted on Map 15, Lot 18 of the tax maps of the Town of Fryeburg, in a northeasterly direction to a gate located at a point adjacent to the property identified as 185 Frog Alley, and further identified as part of the property depicted on Map 15, Lot 2 of the tax maps of the Town of Fryeburg.

LITTLE CHATHAM ROAD: From a point adjacent to a private road known as Hill Farm Estates Road, said road further identified as part of part of the property depicted on Map 13, Lot 20 of the tax maps of the Town of Fryeburg, in a westerly direction to the New Hampshire State Line.

PORTER ROAD: From a point adjacent to the property identified as 178 Porter Road, and further identified as part of the property depicted on Map 3, Lot 34 of the tax maps of the Town of Fryeburg, to its intersection with Farnsworth Road.

RIVER ROAD: From a gate located at a point westerly of Maine Route 5, in westerly direction to a gate located at a point adjacent to the property as depicted on Map 26, Lot 16 of the tax maps of the Town of Fryeburg.
