Board of Selectmen Meeting Minutes
January 4, 2007

The meeting was called to order at 6pm.

Members present: Ed Wilkey, David Knapp.

Review and approval of the minutes of 12/21/06

Ed Wilkey moved to approve the minutes 12/21/06 as printed

David Knapp seconded the motion and it passed unanimously.

Public Forum –

Mr. Dick Krasker would like the selectmen to put on the warrant for 2007 town meeting an article to expand the Board of Selectmen to five persons. He suggested that the two additional members could be elected in June 2007. He would like to see two more people to share the burden of work that the selectmen have.

Dale Heath had pictures of illegally dumped items to in the vicinity of Black Pond and Round Pond. There are a lot of refrigerators and mattresses being dumped along these roads and it is getting to be a problem. It was suggested to give citizens of the town two passes for free dumping of these items twice a year. The passes could be redeemed anytime during the year. The selectmen will look into this issue.

Old Business:

Property tax abatement requests/Town Report requirements.

Ed Wilkey made a motion to partially abate taxes on the following properties:

Map 6, Lot 2; Map 6, Lot 8; Map 6, Lot 10; Map 12, Lot 15.

David Knapp seconded the motion and it passed unanimously.

In answer to the question regarding publishing delinquent taxpayer information in the annual report, pursuant to state law, such a list must appear.

Road Commissioners Report/Discussion regarding Garland Lane Road Acceptance.

Some residents of Garland Lane want the town to make Garland Lane Road a town road and have the town plow it. They are asking the town to accept it as a public roadway. They will hire a contractor or pay the town to bring it up to town specifications. The current condition of the road must be examined to see if it meets the requirements listed in the Land Use Ordinance for public roads. Road Commissioner Gary Whitten noted that a culvert on the road should be replaced before and if the road is accepted.

Discussion re-Planning Board Authority – Bulk Water Sales

A letter was received from Mr. Malia’s office regarding this issue. Mr. Knapp was of the opinion that the letter did not satisfactorily address the questions posed, and the matter will be reviewed again by counsel.

Further Discussion re: Pike Bldg. Inspection Proposal.

The selectmen met with David Hart to talk about work that had to be done for the inspection of the property. David Knapp made a motion to accept the proposal for the inspection for the Pike Building in consideration of the citizen vote. Ed Wilkey seconded the motion and it passed unanimously. The work will be paid for from funds raised at a Special Town Meeting held in 2005 at which time $9,700.00 was appropriated for the study of Public Safety Building options.

New Business

Mt. Washington Valley Mutual Aid Agreement/Fire Department

This agreement is for mutual assistance to Mt. Washington Valley for emergency services. This is a renewal agreement with no changes. Ed Wilkey made a motion to sign the Mt. Washington Valley Mutual Aid Agreement covering the towns of North Conway, Center Conway, Redstone, East Conway, Jackson, Madison and Bartlett. David Knapp seconded the motion and it passed unanimously.

Other Business:

URRIP is a program where towns can cost share with the State Department of Transportation specific projects. Program participants come up with 1/3 of the cost and the state pays 2/3 of the cost. Fryeburg has suggested that River Road, from its intersection with Maine Street (Route 302) to the new bridge be considered from funding. According to DOT computations the road work for this project would be approximately $35,000.00 for the town. This would have to appear on a warrant for a future town meeting. The earliest date that this work could be done is 2008, and only if a state transportation bond package funding the program is approved by the legislature. Anything over and above the basic road re-build (for example: sidewalks and associated drainage) would not fall under this program.

Selectmen have a memo from Chief Brooking regarding the parking lot by the Legion Building. The Department has issued numerous tickets out for parking violations.

Representative Muse and Senator Hastings are co-sponsoring a bill that would allow fees to be charged for campfire permits issued for the Saco River. The fees would support a fund that could be accessed for costs associated with river patrols, garbage disposal, etc.

Ed Wilkey made a motion to enter executive session discussions regarding legal matters. David Knapp seconded the motion and it passed unanimously.

The board returned from its executive session discussion and resumed the regularly-scheduled meeting. It was decided to set up a telephone conference as soon as possible with attorney Michael Hill.

Having no further business, the meeting adjourned at 8:15.
