TOWN OF FRYEBURG BOARD OF SELECTMEN
JUNE 9, 2005 Meeting Minutes
Mr. Wilkey called the meeting to order at 7:00 PM followed by the Pledge of Allegiance. Mr. Dutton was in attendance, as was Town Manager Phil Covelli.
PUBLIC FORUM:
Ken Brown reiterated his belief that a minimum charge should be established for the disposal of any material at the Transfer Station. Mr. Wilkey responded that the fee schedule will be revisited in the future.
LIQUOR LICENSE APPLICATION-FRYE’S TAVERN
The Board members reviewed an application for a renewal of the Liquor License of Frye’s Tavern. Chief Brooking of the Fryeburg Police Department submitted a letter stating that there were no violations of record. Mr. Dutton moved to approve the license as submitted. Mr. Wilkey voted in favor of the motion and the license was signed.
Saco River Recreation Council – Waste Disposal:
Elbridge Russell, on behalf of the Saco River Recreation Council, was present to explain the use of the dumpster at Walkers Bridge. He explained that this particular dumpster is actually leased by the Saco River Recreation Council and, as such, has been allowed to be exempt from Transfer Station charges. Mr. Elbridge reported that launching on the site remains without charge to local residents. After discussion it was decided to continue to allow trash collected at this and other sites overseen by the Saco River Recreation Council to be disposed of free of charge.
Concealed Weapons Permit Policy:
After review, Mr. Dutton moved to approve the Concealed Weapons Permit Policy as drafted by Chief Brooking. Said policy is hereby attached and incorporated into these minutes by reference. The motion passed unanimously.
Municipal Vehicle Use Policy:
Chief Brooking and Chief Sheaff suggested some changes to the Municipal Vehicle Use Policy to allow for activities which both departments are normally engaged in. To wit:
- Chief Brooking suggested that the requirement for driver license checks be amended to read every 12 months, as the volume of checks would be burdensome to County Dispatch if performed every six months.
- Both Chiefs suggested amending the out-of-state travel provision to allow for out-of-state travel for official business.
- Both Chiefs suggested amending the provision barring non-employee passengers to allow for such passengers with Town Manager or Department Head approval.
After discussion, Mr. Dutton moved to approve the above-mentioned changes. Mr. Wilkey voted in favor of the motion and the Town Manager was directed to produce a final draft for signature at the next meeting.
CMP UTILITY POLE PERMIT:
Members of the Board reviewed a CMP pole request for an additional utility pole on Haleytown Road. Road Commissioner Whitten had viewed the proposed site and had no objection to the location. Mr. Dutton moved to approve the permit. Mr. Wilkey voted in favor of the motion and the permit was signed.
BALLOT BOXES:
Mr. Dutton presented a letter of thanks to the Academy student who had constructed the new ballot boxes. The letter was signed by the Board Members present.
Having no further business the meeting was adjourned.

Concealed Weapons Permit Issuance Policy
To insure consistency and compliance with Maine State Statutes, the following policy shall be followed when issuing concealed weapons permits:
- As provided for in MRSA Section 2002, the Board of Selectmen authorize the Chief of Police as their designee for issuing concealed weapons permits
- All applications shall conform to MRSA 25 Chapter 252 §2003-D
- All applications shall be picked up and returned to the Fryeburg Police Department.
- All application fees will be collected at the Police Department.
- Per MRSA 25 Chapter 252 § 2003-E.4 the fees for a concealed weapons permit shall be
- For a new permit $35, $25 of which is to be turned over to the Treasurer of the State. The remaining $10 is to go to the Town.
- For a renewal $20, $15 is to be turned over to the Treasurer of the State. The remaining $5 is to go to the Town.
- All applications shall be stored in a confidential file at the Police Department.
- The Chief of Police shall check the application for completeness and truthfulness.
- The Chief of police shall cause a background check to be made pursuant to Title 25 Chapter 252 § 2003-E.1
- As authorized in MRSA 25 § 2003-E-2, the applicant shall either submit a passport sized photograph along with the application, or submit to being photographed by a Police Department employee using Town equipment.
- The Applicant shall demonstrate either through submitting proper documentation, or in person, the knowledge of handgun safety. Per MRSA 25 § 2003-E-5 the following methods may be used for proper demonstration:
- Demonstrates to the issuing authority a knowledge of handgun safety. The applicant may fully satisfy this requirement by submitting to the issuing authority, through documentation in accordance with this subparagraph, proof that the applicant has within 5 years prior to the date of application completed a course that included handgun safety offered by or under the supervision of a federal, state, county or municipal law enforcement agency or a firearms instructor certified by a private firearms association recognized as knowledgeable in matters of firearms safety by the issuing authority or by the state in which the course was taken. A course completion certificate or other document, or a photocopy, is sufficient if it recites or otherwise demonstrates that the course meets all of the requirements of this subparagraph.
As an alternative way of fully satisfying this requirement, an applicant may personally demonstrate knowledge of handgun safety to an issuing authority, if the issuing authority is willing to evaluate an applicant's personal demonstration of such knowledge. The issuing authority is not required to offer this 2nd option.
The demonstration of knowledge of handgun safety to the issuing authority may not be required of any applicant who holds a valid State permit to carry a concealed firearm as of April 15, 1990 or of any applicant who was or is in any of the Armed Forces of the United States and has received at least basic firearms training.
- The Chief of Police shall cause a copy of appropriate laws and definitions to be furnished to all applicants.
- Upon receipt of a complete application, the Chief of Police shall either issue or deny a concealed weapons permit within 30 days for a resident application, or 60 days for a non-resident.
