Town of Fryeburg WARRANT FOR TOWN MEETING
MARCH 16’TH AND 17’TH 2007
To: Wayne Brooking, Constable to the Town of Fryeburg, in the County of Oxford, State of Maine.
Greetings: In the Name of the State of Maine you are hereby required to notify and warn the inhabitants of said Town of Fryeburg, qualified by the law to vote in said Town affairs, to meet in the American Legion Building, Bradley Street, Fryeburg Village in said Town on the 16th day of March 2007 AD at which place from the hours of 9:00 am to 8:00 pm the polls shall be open for the purpose of electing those Town officials which the Town has voted to elect by secret ballot under Article 1A, also to act on Article 1 below, and to meet in the Fire House on Main Street in Fryeburg at 9:00 am on the 17th day of March, 2007 AD for the purpose of acting on the remaining business set forth in the following Articles to wit:
Article 1) To choose a Moderator to preside at said meeting.
A. To elect by secret ballot in accordance with 30A MRSA §2524 one person to serve as Selectman/Assessor/Overseer of the Poor for a three year term, two persons to serve as School Director (MSAD 72) for a three year term, and one person to serve as alternate School Director (MSAD72) for a one year term.
B. To provide for the appointment of all necessary officers.
C. To establish the salaries of the Selectmen.
Amount requested: - $3,750.00 @$1,250.00/ea. Budget Committee unanimously recommends.
Article 2) To see if the Town will vote to authorize the Selectmen on behalf of the Town to sell and dispose of property acquired by the tax process at public sale, except where it is being sold back to the former owner, when a private sale may be utilized; “Public Sale” shall not mean “Public Auction”, but shall mean a sale pursuant to such published notice in a newspaper of general circulation within the Town as the Selectmen deem appropriate. The terms and conditions of any such sale shall be as the Selectmen deem advisable, in all cases conveyance to be made by municipal quit claim deed. This authorization shall remain in effect until later revoked by the Town. The Selectmen recommend adoption of this article.
Article 3) To see if the Town will vote to authorize the Tax Collector or treasurer to accept prepayments of taxes not yet committed pursuant to 36 MRSA § 506. The Selectmen recommend adoption of this article
Article 4) To see if the Town will vote to turn over 100% of the money received from the registration of snowmobiles to the Interstate Snow-Goers Club for the purpose of maintaining their snowmobile trails, to be open to the use of the public when there is sufficient snow, and to authorize the Board of Selectmen to enter into an agreement with the Club, under such terms as the Board of Selectmen may deem advisable, for that purpose. The Selectmen recommend adoption of this article
Article 5) To see if the Town will vote to set the interest rate to be paid by the Town on abated taxes to four and one half percent (4.50%) for the fiscal year. The Selectmen recommend adoption of this article.
Article 6) To see if the Town will vote to declare taxes for the current year due and payable on October 15, 2007, and to apply a 12% rate of interest to delinquent taxes. The Selectmen recommend adoption of this article.
Article 7) To see if the Town will vote to authorize the Treasurer of the Town to waive the foreclosure of any tax lien mortgage before the expiration of the right of redemption, after consultation with and upon the consent of the Board of Selectmen, in accordance with 36 MRSA § 944. This authorization shall remain in effect until later revoked by the Town. The Selectmen recommend adoption of this article
Article 8) To see if the Town will vote to authorize the Municipal Officers to execute and deliver Quitclaim deeds at their discretion for the purpose of removing from Public Record tax liens that have not been discharged through inadvertence. This authorization shall remain in effect until later revoked by the Town. The Selectmen recommend adoption of this article
Article 9) To see if the Town will authorize the Board of Selectmen to transfer funds from line item budget accounts that have surplus funds at the end of the 2007 fiscal year to line item budget accounts that have deficits at the end of the 2007 fiscal year, provided any such transfer is approved at a properly called public meeting of the Board of Selectmen. The Selectmen recommend adoption of this article
Article 10) To see if the Town will vote to accept any gifts, unanticipated donations, or pass-through funds that may be provided by individual(s), business associations, charitable groups, or other organizations, which have not been listed in any of the previous or following articles, if the Selectpersons determine that the gifts, donations, or pass-through funds and their purposes are in the best interest of the Town. The Selectmen recommend adoption of this article
Article 11) To see if the Town will vote to authorize the Municipal Officers to apply for, accept, and appropriate State, Federal, or private foundation grants or funds, including, but not limited to, Community Development Block Grant Funds that may be available to and in the best interest of the Town. This authorization shall remain in effect until later revoked by the Town. The Selectmen recommend adoption of this article
Article 12) To see if the Town will vote to authorize the Board of Selectmen to dispose of Town owned personal property with a value of $25,000.00 or less upon such terms and conditions as it deems advisable. The Selectmen recommend adoption of this article
Article 13) To see if the Town will vote to authorize the Selectmen to spend an amount not to exceed 1/2 of the January 1’st 2007 through June 30’th 2007 annual budget appropriations during the period from January 1, 2007 to the March 2007 Town Meeting. The Selectmen recommend adoption of this article
Article 14) To see if the Town will vote to raise and/or appropriate up to $36,000.00 to pay tax abatements and applicable interest granted during the fiscal year. The Selectmen and Budget Committee recommend adoption of this article by unanimous vote.
Article 15) To see if the Town will vote to accept for purposes of improving the Eastern Slope Regional Airport, grants from the State of Maine (Bureau of Aeronautics) and the United States of America (Federal Aviation Administration) and to authorize the Selectmen to enter into grant agreements with such agencies as may be required, provided the Board of Selectmen shall first determine to its satisfaction that the local share required under any such grant agreement will be borne entirely by the Eastern Slope Airport Authority and not by the Town. This authorization shall remain in effect until later revoked by the Town. The Selectmen recommend adoption of this article
Article 16) To see if the Town will vote to authorize the Board of Selectmen to lease the so-called "Rescue Building" located on Rte. 302 (Tax Map 43, Lot 40), to the Fryeburg Rescue Association upon such terms and conditions as the Selectmen deem advisable; and further to authorize the Selectmen to enter into a Rescue Services Agreement with Fryeburg Rescue upon such terms and conditions as the Selectmen deem advisable. The proposed lease, which requires Fryeburg Rescue to maintain liability insurance and requires the Town to continue to carry fire and casualty insurance on the building, runs for an initial term of ten (10) years for one dollar ($1) per year. The proposed Rescue Services Agreement, which also runs for an initial term of ten (10) years, ensures that Fryeburg Rescue will continue to serve as Fryeburg's primary agency for emergency medical services.
Words of explanation: The Town's insurance carrier, and the town's auditor, have each instructed the Town and Fryeburg Rescue that the relationship between them needs to be clarified, which is what these documents attempt to do. However, in creating these documents, the Town and Fryeburg Rescue have attempted to recognize and protect the longstanding historical operational relationship and mutual cooperation between them. Due to the length of the proposed lease agreement and the proposed rescue services agreement, the full texts of these documents are not reprinted here. They are available for review at the Town Municipal Offices during regular business hours. The Selectmen recommend adoption of this article
Article 17) Shall the Fryeburg Land Use Ordinance be amended as follows :
The existing Section 15 (Wellhead Protection Overlay District), Section 16Q (which sets forth performance standards for water quality protection), Section 16R (which sets forth performance standards for aquifer protection), and Section 17G (which sets forth standards for Ground Water and/or Spring Water Extraction and/or storage) shall all be replaced by a new Section 15 entitled “Water Resource Protection and Wellhead Protection”. In addition, Section 16S (which sets forth Best Management Practices for Wellhead Protection Areas) will be removed from Section 16 and transferred to the new ordinance in its entirety.
Words of explanation : Due to the length of the new proposed Section 15, the full text of the newly proposed section, as well as a map delineating the proposed Wellhead Protection Areas are not reprinted here. They are available for review at the Town Municipal Offices during regular business hours. The text of the new Section may be viewed on the Town’s website at http://www.fryeburgmaine.org The Planning Board recommends adoption of this article by unanimous vote.
Article 18) To see if the Town will vote to authorize the municipal officers to make final determinations regarding the closing or opening of roads to winter maintenance pursuant to 23 MRSA, Section 2953. The Selectmen recommend adoption of this article .
Article 19) To see if the Town will vote to approve the Municipal Officers’ Order of Discontinuance of a portion of the former State Aid Highway No. 5, dated February 15, 2007 and filed with the Town Clerk. The Selectmen recommend adoption of this article.
Article 20) To see if the Town will vote to expand the size of its Board of Selectmen from three members to five members, pursuant to 30A MRSA 2526(4)(A) and 30 MRSA 2528 (2) and (2A), effective with the next town meeting election held at least ninety (90) days from the date of the vote on this article as follows: in addition to voting to fill the expiring term of an existing seat on the Board, if any, to vote to fill two additional, new seats:
a) One (“seat 4”) to be initially for a two year term, then upon the expiration of that initial term to be filled by election for successive three year terms:
b) One (“seat 5”) to be initially for a one year term then upon the expiration of that initial term to be filled by election for successive three year terms. Submitted by petition.
Article 21) To see if the Town will vote to accept the provisions of 30A MRSA 2528 (“secret ballot”) for the election of the additional members of the Board of Selectmen. Submitted by petition.
Article 22) To see if the Town will vote to fix the date of the next annual town meeting (in the event the Town votes to change its fiscal year and hold its annual town meetings in June) for a date which is ninety (90) days or more from the date of the vote on this article, and to include as a part thereof an election pursuant to 30A MRSA 2528 (“secret ballot”) for the two additional, new seats on the Board of Selectmen for the respective terms as by vote on an earlier article of this meeting have been established. Submitted by petition.
Article 23) To see if the Town will vote to raise and appropriate the sum of $25,500.00 for the Machinery Capital Reserve Account (created pursuant to Article 22 of the 2006 annual town meeting warrant) and to expend a sum not to exceed $25,500.00 for the purchase of computer software and peripherals for the Town Office.” Budget Committee/Selectmen unanimously recommend.
Article 24) To see if the Town will vote to raise and appropriate the sum of $15,000.00 for the Machinery Capital Reserve Account (created pursuant to Article 22 of the 2006 annual town meeting warrant) and to expend a sum not to exceed $15,000.00 for the purchase of computer software for the Police Department. Budget Committee/Selectmen unanimously recommend.
Article 25) To see what sum of money, if any, the town will vote to authorize the municipal officers to appropriate from un-appropriated surplus as they deem advisable to meet unanticipated expenses and emergencies that occur during fiscal year 2007. The Selectmen recommend $ 10,000.00. The Budget Committee recommends $0 (by a 3-2 vote).
Article 26) To see if the Town will vote to raise and appropriate $4,250.00 for the Board of Selectmen account. Budget Comm. unanimously recommend.
Words of explanation: In addition to the salaries as detailed in Article 1 (c), this line also contains a $500.00 allocation for training seminars and materials. The Budget Committee recommends adoption of this article by a vote of 4-1.
Article 27) To see if the Town will vote to raise and/or appropriate $184,527.50 for the Town Administration account. Budget Committee/Selectmen unanimously recommend.
Article 28) To see if the Town will vote to raise and/or appropriate $500.00 to upgrade Town Office Computer Equipment. Budget Committee/Selectmen unanimously recommend.
Article 29) To see if the Town will vote to raise and/or appropriate $1,300.00 for the Planning Board account. Budget Committee/Selectmen unanimously recommend.
Article 30) To see if the Town will vote to raise and/or appropriate $275.00 for the Appeals Board Account. Budget Committee/Selectmen unanimously recommend.
Article 31) To see if the Town will vote to raise and/or appropriate $1,000.00 to update the Comprehensive Plan. Budget Committee/Selectmen unanimously recommend.
Article 32) To see if the Town will vote to raise and/or appropriate $150.00 for the Recycling Comm. Account. Budget Committee/Selectmen unanimously recommend.
Article 33) To see if the Town will vote to raise and/or appropriate $42,000.00 for the Professional Services Account. Budget Committee/Selectmen unanimously recommend.
Article 34) To see if the Town will vote to raise and/or appropriate $3,000.00 for the General Assistance Account. Budget Committee/Selectmen unanimously recommend.
Article 35) To see if the Town will vote to raise and/or appropriate $30,000.00 for the cost of short term borrowing (Tax Anticipation Note). Budget Committee/Selectmen unanimously recommend.
Article 36) To see if the Town will vote to raise and/or appropriate the sum of $1,750.00 for the purpose of providing for the videotaping of meetings and other programs of interest to the Town.
Words of Explanation: The Town is expected to receive approximately $5,300.00 from Adelphia Cable for 2006 franchise fees. Article 73 seeks to appropriate $1,860.00 from this $5,300.00 to Valley Vision. This article seeks to utilize the balance to fund the taping of meetings and other programs of interest to the Town to be aired on the local public access channel. Article 37) To see if the Town will vote to raise and/or appropriate the sum of $2,180.00 for the Economic Development Account. The Selectmen recommend adoption of this article. The Budget Committee recommends $2,100.00.
Article 38) To see if the Town will vote to raise and/or appropriate $32,133.50 to supplement funds provided from other sources for the Recreation Department. Budget Committee/Selectmen unanimously recommend.
Article 39) To see if the Town will vote to raise and/or appropriate $5,000.00 for maintenance of the Recreation Field. The Selectmen recommend adoption of this article. The Budget Committee recommends $1,000.00
